What this document is

This is the power of attorney form (หนังสือมอบอำนาจ, form T.D. 21) of the Thai Department of Lands (กรมที่ดิน) with the printed subject “ได้มาโดยการครอบครอง” — acquisition by possession. With it the principal authorises another person (agent) to register, at the Land Office, the acquisition of the land by possession and to give statements to the officer.

Acquisition by possession (under Thai law, open and peaceful possession of another’s land with the intention to own it for the period set by law) is registered on the basis of a court order or judgment. The powers text therefore gives the court, the “black” and “red” case numbers and the date of the order or judgment. The form is meant for land with a โฉนด title deed.

Who fills it in and where it is filed

  • principal — the person whom the court has recognised as having acquired the land by possession;
  • agent — the person who attends the Land Office instead of the principal;
  • the power of attorney is filed at the Land Office (สำนักงานที่ดิน) where the land is located, at registration;
  • it is signed by the principal and two witnesses.

What the form asks for

  • land details from the title deed: map sheet (ระวาง), parcel number, survey page, title deed number, sub-district, district, province;
  • place and date of signing, year in the Buddhist Era (B.E.);
  • the court and the type of decision (order — คำสั่งศาล, or judgment — คำพิพากษาศาล), black and red case numbers, date of the order or judgment;
  • principal and agent: name in Thai script, age, ethnicity, nationality, parents’ names, address per house registration, telephone;
  • the Thai ID number is printed in the boxes (left blank for a foreigner without a Thai ID); signatures by hand.

What is usually attached

  • the original title deed (โฉนดที่ดิน), if available;
  • a certified copy of the court order or judgment and, as a rule, a certificate that it has become final;
  • signed copies of the Thai ID card (or passport) and house registration of the principal and the agent.

The form does not list all attachments, fees or processing times — check with the Land Office where the land is located.
