What this document is

Form BT.53 (แบบแจ้งคนต่างด้าวออกจากงาน) is a form of the Department of Employment (กรมการจัดหางาน), Ministry of Labour of Thailand. The employer uses it to inform the registrar that a foreign worker they employed has left the job.

The form cites Section 13 paragraph one, Section 46 paragraph three or Section 50 paragraph one (3) of the Royal Ordinance on the Management of Foreign Workers. It has two pages in Thai: the notification itself and, on the back, the list of documents and office notes.

Who files it and where

  • the employer of the foreign worker — a company or an individual (the form is marked "for employers of foreign workers");
  • the employer in person or an attorney-in-fact under a power of attorney;
  • at the provincial employment office or the Bangkok employment office area (สำนักงานจัดหางาน) — check with the office which one handles your notification;
  • the table on the form has four rows; if more workers left, fill in another copy of the form.

What the form asks for

  • date of the notification (Buddhist Era year, พ.ศ.);
  • employer's name or company name, Thai ID card number or juristic person registration number;
  • type of business, employer's address and phone;
  • for each worker: name, nationality, work permit number, passport or substitute document number, date of leaving and reason;
  • name of the signatory and date of signing.

Documents to attach

The list on the back of the form:

  • if the employer files in person: Thai ID card (the officer makes the copy); a copy of the juristic person registration certificate if the employer is a company;
  • if an attorney files: a power of attorney with duty stamps, a copy of the principal's ID card, the attorney's ID card (the office makes the copy) and any other documents requested.

The form does not state the deadline, fees or online filing options. The deadline is set by Section 13 of the Ordinance (commonly cited as 15 days from the date the worker leaves) — check the current requirements with the employment office.
