What this document is

405F1 (“Denuncia/Solicitud de Acreditación del Depósito de Fianzas”) is the official form a tenant in the Madrid region uses to ask the Agencia de Vivienda Social to confirm that the landlord lodged the lease deposit (fianza) with the Comunidad de Madrid, or to report that it was not lodged.

Under the Urban Leases Act (art. 36.1 Ley 29/1994) a cash deposit equal to one month’s rent is compulsory for a residential lease. Regions may require the landlord to lodge it with the administration until the lease ends (additional provision 3); in the Madrid region this is set by Ley 12/1997 and Decreto 181/1996.

Who files it and where

  • the tenant (inquilino) of a home in the Comunidad de Madrid — in person or through a representative, who attaches a copy of the power of attorney;
  • addressee — Consejería de Vivienda, Transportes e Infraestructuras, Agencia de Vivienda Social;
  • notifications — electronically (only if registered in the Comunidad de Madrid notification system) or by registered mail;
  • check the filing channel, appointments and processing times on comunidad.madrid before filing.

What the form asks

  • tenant: NIF/NIE, given name and two surnames (or company name), e-mail, phones, address;
  • representative (if someone files for you) and how to be notified, with recipient and postal address;
  • landlord (arrendador): NIF/NIE, name or company name, contacts, address;
  • contract: date, initial rent, address of the rented home, end date (if the lease has ended);
  • tick for the attached copy of the contract, place and date of signing.

What to bring

  • a copy of the lease contract — the form expressly requires it;
  • the tenant’s ID document (DNI, NIE or passport);
  • if filed by a representative — a copy of the power of attorney (poder);
  • confirm the exact list for your case with the Agencia de Vivienda Social.
